Unboxed: Stand-Up Desks Gaining Favor in the Workplace





THE health studies that conclude that people should sit less, and get up and move around more, have always struck me as fitting into the “well, duh” category.




But a closer look at the accumulating research on sitting reveals something more intriguing, and disturbing: the health hazards of sitting for long stretches are significant even for people who are quite active when they’re not sitting down. That point was reiterated recently in two studies, published in The British Journal of Sports Medicine and in Diabetologia, a journal of the European Association for the Study of Diabetes.


Suppose you stick to a five-times-a-week gym regimen, as I do, and have put in a lifetime of hard cardio exercise, and have a resting heart rate that’s a significant fraction below the norm. That doesn’t inoculate you, apparently, from the perils of sitting.


The research comes more from observing the health results of people’s behavior than from discovering the biological and genetic triggers that may be associated with extended sitting. Still, scientists have determined that after an hour or more of sitting, the production of enzymes that burn fat in the body declines by as much as 90 percent. Extended sitting, they add, slows the body’s metabolism of glucose and lowers the levels of good (HDL) cholesterol in the blood. Those are risk factors toward developing heart disease and Type 2 diabetes.


“The science is still evolving, but we believe that sitting is harmful in itself,” says Dr. Toni Yancey, a professor of health services at the University of California, Los Angeles.


Yet many of us still spend long hours each day sitting in front of a computer.


The good news is that when creative capitalism is working as it should, problems open the door to opportunity. New knowledge spreads, attitudes shift, consumer demand emerges and companies and entrepreneurs develop new products. That process is under way, addressing what might be called the sitting crisis. The results have been workstations that allow modern information workers to stand, even walk, while toiling at a keyboard.


Dr. Yancey goes further. She has a treadmill desk in the office and works on her recumbent bike at home.


If there is a movement toward ergonomic diversity and upright work in the information age, it will also be a return to the past. Today, the diligent worker tends to be defined as a person who puts in long hours crouched in front of a screen. But in the 19th and early 20th centuries, office workers, like clerks, accountants and managers, mostly stood. Sitting was slacking. And if you stand at work today, you join a distinguished lineage — Leonardo da Vinci, Ben Franklin, Winston Churchill, Vladimir Nabokov and, according to a recent profile in The New York Times, Philip Roth.


DR. JAMES A. LEVINE of the Mayo Clinic is a leading researcher in the field of inactivity studies. When he began his research 15 years ago, he says, it was seen as a novelty.


“But it’s totally mainstream now,” he says. “There’s been an explosion of research in this area, because the health care cost implications are so enormous.”


Steelcase, the big maker of office furniture, has seen a similar trend in the emerging marketplace for adjustable workstations, which allow workers to sit or stand during the day, and for workstations with a treadmill underneath for walking. (Its treadmill model was inspired by Dr. Levine, who built his own and shared his research with Steelcase.)


The company offered its first models of height-adjustable desks in 2004. In the last five years, sales of its lines of adjustable desks and the treadmill desk have surged fivefold, to more than $40 million. Its models for stand-up work range from about $1,600 to more than $4,000 for a desk that includes an actual treadmill. Corporate customers include Chevron, Intel, Allstate, Boeing, Apple and Google.


“It started out very small, but it’s not a niche market anymore,” says Allan Smith, vice president for product marketing at Steelcase.


The Steelcase offerings are the Mercedes-Benzes and Cadillacs of upright workstations, but there are plenty of Chevys as well, especially from small, entrepreneurial companies.


In 2009, Daniel Sharkey was laid off as a plant manager of a tool-and-die factory, after nearly 30 years with the company. A garage tinkerer, Mr. Sharkey had designed his own adjustable desk for standing. On a whim, he called it the kangaroo desk, because “it holds things, and goes up and down.” He says that when he lost his job, his wife, Kathy, told him, “People think that kangaroo thing is pretty neat.”


Today, Mr. Sharkey’s company, Ergo Desktop, employs 16 people at its 8,000-square-foot assembly factory in Celina, Ohio. Sales of its several models, priced from $260 to $600, have quadrupled in the last year, and it now ships tens of thousands of workstations a year.


Steve Bordley of Scottsdale, Ariz., also designed a solution for himself that became a full-time business. After a leg injury left him unable to run, he gained weight. So he fixed up a desktop that could be mounted on a treadmill he already owned. He walked slowly on the treadmill while making phone calls and working on a computer. In six weeks, Mr. Bordley says, he lost 25 pounds and his nagging back pain vanished.


He quit the commercial real estate business and founded TrekDesk in 2007. He began shipping his desk the next year. (The treadmill must be supplied by the user.) Sales have grown tenfold from 2008, with several thousand of the desks, priced at $479, now sold annually.


“It’s gone from being treated as a laughingstock to a product that many people find genuinely interesting,” Mr. Bordley says.


There is also a growing collection of do-it-yourself solutions for stand-up work. Many are posted on Web sites like howtogeek.com, and freely shared like recipes. For example, Colin Nederkoorn, chief executive of an e-mail marketing start-up, Customer.io, has posted one such design on his blog. Such setups can cost as little as $30 or even less, if cobbled together with available materials.


UPRIGHT workstations were hailed recently by no less a trend spotter of modern work habits and gadgetry than Wired magazine. In its October issue, it chose “Get a Standing Desk” as one of its “18 Data-Driven Ways to Be Happier, Healthier and Even a Little Smarter.”


The magazine has kept tabs on the evolving standing-desk research and marketplace, and several staff members have become converts themselves in the last few months.


“And we’re all universally happy about it,” Thomas Goetz, Wired’s executive editor, wrote in an e-mail — sent from his new standing desk.

Shoemaker Annie Mohaupt nearly closed down a year ago after her move to make sandals in China proved a bust. The sandals could easily be pulled apart.

She looked into what it would cost to make her sandals in another country but returned production to Chicago. The decision, she said, allows her to tap into growing demand for U.S.-made products and to utilize manufacturing technology that makes her company, Mohop Inc., a global competitor.






"I have a factory," Mohaupt said, her statement reflecting her evolution from thinking of herself solely as a designer. As a manufacturer she understands she has control over the quality of her products — a key to sales and growth. "I'm happy but it's also intimidating. There is a lot to manage and wrap my head around."

Mohaupt's tale is illustrative of what manufacturing experts and politicians have been saying for quite some time: American manufacturers can be successful and create jobs by using the latest technology in producing and developing products.

So far this year, Mohaupt has sold about 1,500 pairs of sandals for about $158,000, she said. Mohaupt credits Facebook fans and word-of-mouth recommendations for a 500 percent increase in sales this fall over a year ago, and she expects to sell about 5,000 pairs of sandals in 2013. When she reaches annual sales of 10,000 pairs, Mohaupt said she'll need to invest in more equipment, like a new wood-cutting machine.

"I want for her to be making her shoes in the U.S.," said Greg Kaleel, owner of American Male & Co. a family-owned retail shop in Oswego, adding that his customers will pay more for shoes made here. "That's how important the 'made in America' is."

On a recent evening, the sweet smell of burned walnut filled Mohaupt's basement shop in a three-story building in Chicago's River West neighborhood. The smell emanated from a computerized machine about the size of a pingpong table cutting walnut blocks into triangles with concave curves and arches. Those curves support the heel and arch of a woman's foot and create a sleek, sophisticated look.

An architect by training, Mohaupt, 37, feeds her three-dimensional designs into a program that converts it into letters and numbers and tells the machine where to cut. That was the easy part for her to learn. To operate the machine, Mohaupt relied on a tutorial from the machine-maker and learned the rest via the Internet.

The soft-spoken woman employs three people, including an office manager and a young designer. If sandals sell as planned, she would hire four to six temporary workers in the spring. That's when sales typically ramp up after the winter lull. Mohaupt wants to expand her product line to lessen her dependence on sandal sales. One idea is a moccasin she can sell in the cold months.

Mohaupt has come a long way since 2005, when she cut and glued layers of plywood by hand to make her sandals. Her early versions featured a cylindrical wooden heel and elastic loops on each side of the sole that acted as guides for ties or ribbons that customers could change at will — her signature design.

She sold her first sandals for $70 at a craft fair and appeared to be off and running. The bliss of her success crumbled the following morning when customers complained that the shoes easily came apart. The heels broke off and the loops snapped. In effect, the stumble marked the beginning of her apprenticeship as a manufacturer.

Mohaupt spent the next year quizzing seasoned shoemakers and shoe repairers about how she could improve the quality of her shoes. Ultimately, she decided that her sandals should be able to withstand 100 miles of use. To test her designs, she wore her sandals while taking her dog on five-mile treks.

"I lost some weight," she said. She also test-marketed the evolving sandals by mailing samples to her first customers. Some got up to five pairs as Mohaupt developed — and later patented — a system to keep the elastic loops in place. One problem licked, she then focused on the labor involved.

Cutting the plywood by hand was grueling work in its own right. And then she had to glue together the layers. "I would end up covered in glue," she said.

So Mohaupt began experimenting with wooden blocks, which she'd sculpt with a saw into wedges. That eliminated having to glue together layers of plywood but still was physically draining.

That's when she made a decision that would forever change her business. In 2009 she bought on credit a $70,000 computer-driven machine that could read her 3-D designs and cut heels in minutes, saving hours of labor. The machine also allowed Mohaupt to experiment with new designs. For example, she could for the first time produce curved heel bases and make shoes with added arch support.

Demand grew steadily, which should have been a good problem. But even with the machine she couldn't keep pace with orders. Mohaupt tried training people to make the sandals but found that she couldn't train them and make shoes at the same time.

That's when she first considered outsourcing production. She tested a Canadian shoemaker but severed the relationship after it sent her a shipment of poorly made shoes. Mohaupt also was unsuccessful in lining up production in Argentina.

Then, suddenly, a competitor emerged that jolted her into making a decision that ultimately would nearly bring down her company. The competitor was selling sandals almost identical to hers and nudging her sandals out of local shops she had supplied for years. Its prices also were lower because it was producing its sandals in China. She faced being driven out of business, she said.

Alabama wins SEC title, will face Notre Dame next









ATLANTA -- Long after enough blue, white and yellow streamers and confetti fell from the roof to blanket the Georgia Dome floor, Alabama linebacker Nico Johnson sat in front of a locker room stall in the corner and endured the pop quizzes after surviving a torturous exam.

The Crimson Tide beat Georgia for the SEC championship, a 32-28 affair that was ear-splitting and catwalk-rattling from the time the teams stretched. It was on to the BCS title game. It was on to Notre Dame. And it was on to consulting media guides or Wikipedia or whatever might inform Johnson of what he was in for.

"That's like the third time somebody asked me about the history of Alabama-Notre Dame," Johnson said. "I just want to know what went on between these two teams because apparently it was something special."

Whatever he finds, whatever grainy, houndstoothed chronicles he encounters, it will be past that can't measure up as prologue.

This is a national championship match weighty enough to drop south Florida below sea level, Notre Dame seeking its return to the pinnacle against the defending national champions and the foreboding gloom cast by the swaggering, indomitable SEC, which has laid claim to the last six crystal ball trophies.

Notre Dame and Alabama have met six times before. That was then. This is wow.

"It's two teams with a lot of tradition," Alabama center Barrett Jones said. "That's not what it's going to come down to. It's not going to come down to who has a better tradition or history.

"It's going to come down to who plays the best game. But it's hard for me to even think of that right now. We're trying to savor this one. We might even have to extend the 24-hour rule to 48 or something."

Either cycling through mind games or simply compulsively focused, Crimson Tide coach Nick Saban said he didn't know the date of the Jan. 7 BCS title game and wouldn't start preparing for Notre Dame until practices began.

What he and Irish coach Brian Kelly will see: Two teams that are almost frighteningly analogous.

Two pulverizing tailbacks followed a stout offensive line to 350 yards rushing Saturday. An error-plagued quarterback was redeemed by a game-winning 45-yard touchdown pass. The defense surrendered 21 points -- Georgia notched a special teams score -- but just 113 yards rushing.

"I don't know a whole bunch about Notre Dame, but I look forward to this game," Alabama guard Anthony Steen said. "I was looking forward to this game against Georgia. Everybody was saying they had a good D-line, and I wanted to see how good they were. I'm looking forward to seeing how good Notre Dame's D-line and linebackers are."

Oh, everyone is looking forward to this, all right.

"I'm pretty sure it gets the old-heads excited, people that are in their 50s and 60s," Alabama linebacker C.J. Mosley said. "It's going to be a historic game."

A.J. McCarron, the goat-turned-hero quarterback for Alabama on Saturday, said he knew nothing about Notre Dame other than that his brother rooted for the Irish. Past is past. The title game is here, and how.

"It's definitely awesome," McCarron said. "But it's not worth it unless we go there and win it."

Seth MacFarlane on “Family Guy” movie: “it’s just a matter of when”












NEW YORK (TheWrap.com) – “Family Guy” creator Seth MacFarlane wants to bring his beloved and controversial Fox show to the big screen, telling students at UCLA on Wednesday that a theatrical version of the show will definitely happen.


“It’s just a matter of when,” MacFarlane said, according to Entertainment Weekly. “It’s hard to do that while you have the series going on at the same time; I think that’s why it took ‘The Simpsons’ 20 seasons to figure out how to do it.”












“Family Guy,” which is in its 11th season, has made MacFarlane one of the most successful writers in television. A writer, director, voice actor and animator – not to mention singer-of-standards and this year’s Oscar host – MacFarlane created that show, as well Fox shows “American Dad” and “The Cleveland Show.”


He also had been working on a reboot of “The Flintstones,” but that appears to be shelved for now.


MacFarlane then transformed into one of the film industry’s hottest commodities this summer thanks to the breakout success of “Ted,” the Universal comedy that has set a new box-office record for an original, R-rated comedy.


While Universal has every intent of making another “Ted,” MacFarlane said he also has developed the ideas for a “Family Guy” film.


“We do know what the ‘Family Guy’ movie will be,” he told the students. Drawing another comparison to “The Simpsons Movie,” he said his one criticism of the cinematic version of that iconic show was that the plot would have worked on TV.


He claimed his “Family Guy” idea “would be impossible to do on TV.”


The Hollywood Reporter wrote last year that there is a deal in place for a ‘Family Guy” movie, but MacFarlane’s representatives did not respond to a request for more information about the rights to the movie or MacFarlane’s plans.


While MacFarlane still spends a good deal of his time working on television projects, the prospect of a “Family Guy” movie raises two questions: Does he have to make “Ted” first? Does Fox have the rights to the movie?


Neither Universal nor Fox have returned requests for comment.

Jewel parent says sale talks proceeding

Supervalu, the Minneapolis-based parent of Jewel-Osco said sale talks are proceeding after stock closed down more than 18 percent Thursday, to $2.28.

The beleaguered grocery chain was likely moving to combat reports that sale talks with suitor Cerberus Capital Management had stalled over funding.

"The company continues to be in active discussion with several parties," according to the statement. "There can be no assurance that this process will result in any transaction or any change in the Company's overall structure or its business model."

Supervalu, the third-largest U.S. grocery chain, has acknowledged sale talks since the spring. The company has been closing stores and cutting jobs as it has underperformed competitors like Dominick's parent Safeway and Kroger.

If Supervalu does not sell to Cerberus, it may have to restructure on its own or sell off individual assets, which could have big tax consequences, Bloomberg said.

Reuters reported last month that buyout firm Cerberus was preparing a takeover bid for Supervalu, the third-largest U.S. supermarket chain.

Cerberus officials could not be reached immediately for comment.

Officials: 6 shot, 1 fatally, on South Side

A total of six people were shot, one fatally, in two shootings on the South Side, officials said.

In the first shooting, two 19-year-old men were reported shot on the 1100 block of West 51st Street, police said. The Shooting was reported at 6:11 p.m., said Chicago Fire Department Chief Joseph Roccasalva.

The men were both taken in serious-to-critical condition to John H. Stroger, Jr. Hospital of Cook County.

One of the men was reportedly shot in the back and the second man was shot in the hand, leg, side and buttocks, said Chicago Police News Affairs Officer VeeJay Zala.

Minutes after that shooting, four people were shot on the 4200 block of South Wells Street at 6:21 p.m., said Roccasalva.


A 30-year-old man sustained a gunshot wound to the head and a 38-year-old man was shot in the neck, both were taken to John H. Stroger, Jr. Hospital of Cook County. The younger man  reportedly died, officials said.


A 32-year-old man was sustained a gunshot wound to the stomach. A 27-year-old man waa shot in the leg and taken to Mercy Hospital where his condition was stabilized.








Two of the victims were taken in serious-to-critical condition to Stroger Hospital, one person was taken to Mercy Hospital in fair-to-serious condition and one person was reported dead on the scene, said Roccasalva.


The four victims were shot inside and outside of a home in the 4200 block of South Wells Street, police said.

The victim who was killed, 30-year-old William Martin, was shot in the head inside the home, according to police and the victim's family.


Martin was the second child Thelma Smith lost to gunfire this year, she said. Another son, Samuel Clay, was shot and killed in April near 45th Street and Saint Lawrence Avenue, she said.


"I don't know what this world is coming to, you with all this shooting," Martin's mother, Smith, 48, said through tears from the porch of her mother's home on the next block.


She said Martin was in the home, where a friend of his lived, when the bullets pierced through the window and struck Martin and at least one other victim.


Smith, who has four other children, said Martin was studying to become a Jehovah's Witness. She said he had six children and got married last year. 


"Oh my God! I can't believe this! Another one of my kids is getting buried. I have to bury another one of my kids," said Smith.


Police said the gunshots may have come from an alley west of the home, across the street. No one was in custody.

Police couldn't say what led to the shooting, but the block is in the middle of an area where two gangs are in conflict with one another.

There's no indication the shooting is related to the other one at 51st and Wells Streets, police said.

About 20 onlookers gathered on sidewalks and stoops in the 4200 block of South Wells Street where beat cops and detectives were going door to door scouring for witnesses.

A female voice could be heard screaming down the block. Two others were consoling each other with tears in their eyes in the middle of the street.

One officer approached a group of people outside the yellow tape and asked loudly, "Did anybody see anything?"

Nobody said anything back to the officer as she walked away from them.

Rolita Lofton, 34, stood crying at the edge of the police tape Friday night near the shooting site on Wells Street.

"They hit my brother in the chest," Lofton said.

Lofton said her brother, Orivell Chester, 32, was one of the four shot Friday night.

Lofton said she was told her brother was in surgery but did not know the hospital. She said Chester worked at McCormick Place and recently got off work.

Marcus Keene, 38, said he heard the shooters came through the gangway on Wells Street and just started shooting at a group of men gathered on the porch.

He said two of the men shot were on the porch while the other two shot were sitting on the couch inside the next house over. Keene said he believes one of the men who were struck while inside the house has already died.

Keene, who works as a CTA bus driver, expressed frustration.

"Why? Who knows. Is this sad? Yes. The powers at be aren't doing what they should do and neither are the people here," Keene said.

Several police vehicles and an amblance was also stationed on the block full of two-story apartment houses.

Linda McCullough was watching television at her home when she heard about five gunshots. She then went outside to see what was going on.

She says the neighborhood is usually quiet.

"We have some trouble maybe every four years," she said. "People start acting crazy."

In addition to those shootings, a man was found dead of apparent gunshot wounds on the 8200 block of South Dobson, police said.

The victim may have been dead for several weeks and was found in a half-way house, a police source said. The man sustained several gunshot wounds, police said.

Zynga shares slide after privileged status with Facebook ends












(Reuters) – Shares of gaming company Zynga Inc fell as much as 10 percent, a day after the “Farmville” creator reached an agreement with Facebook Inc that reduces its dependence on the social networking giant.


The companies reported in regulatory filings on Thursday that they have reached an agreement to amend a 2010 deal that was widely seen as giving Zynga privileged status on the world’s No.1 social network.












Zynga gets a freer hand to operate a standalone gaming website, but gives up its ability to promote its site on Facebook and to draw from the thriving social network of about 1 billion users.


“Although Zynga investors have reacted negatively to Thursday’s announcements so far, we view them as a long-term positive for both companies,” Wedbush Securities analyst Michael Pachter said in a note to clients.


“Zynga now has an advantage to offer more payment options which could result in additional subscribers who are not Facebook users,” he said, maintaining his “outperform” rating and price target of $ 4 on the stock.


Both internet companies have been trying to reduce their interdependence, with Zynga starting up its own Zynga.com platform, and Facebook wooing other games developers.


In recent quarters, fees from Zynga contributed 15 percent of Facebook’s revenue, while Zynga relies on Facebook for roughly 80 percent of its revenue.


Francisco-based Zynga’s shares were down 7 percent at $ 2.44 in morning trading on the New York Stock Exchange on Friday.


Facebook shares were down more than 1 percent at $ 26.98.

Dolly Parton talks dreams, love, plastic surgery












NEW YORK (Reuters) – Although Dolly Parton has cemented her place in country and popular music, pop culture, and as an entrepreneur and philanthropist, she still, on occasion, gets nervous.


Her new book, “Dream More: Celebrate the Dreamer in You” encourages readers to overcome their fears, believe in their passions and keep taking risks.












The “I Will Always Love You” singer/songwriter, 66, who has written more than 3,000 songs and sold more than 100 million records, talked to Reuters about the message of the book, which was published this week.


Q. You say you put off writing this book?


A. “It’s just a simple little book. It’s not meant to save the world, or it’s not a complete book of how to be successful, but I think there is enough stuff in it for people to see kinda how I conduct my business and kinda what my thoughts are. And the good part is that all the money, if it sells good, goes to Imagination Library.”


Q. Right – your nonprofit quest to get kids to read?


A. “It’s one of the reasons I wanted to write this too, because I usually do concerts every year, for the foundation to make money to afford a lot of books, but I am not on tour now.”


Q. Talk about your 2009 commencement address at the University of Tennessee. Were you nervous?


A. “Well, yes, when I am out of my element doing things. I am not that educated and I didn’t go that far in school and I thought, ‘What am I going to say to these educated people, not just these kids who have just graduated college and are probably brilliant, but all these professionals and all these teachers?’ And I thought, ‘Oh, I am not smart enough’, but I thought, ‘Well, at least I am a hometown girl. At least they can see that in America, you can start from humble beginnings, that everybody can make it.”


Q. Which is one of the book’s messages, overcoming fears?


A. “Any time I am in a situation where I am just not comfortable, I am uneasy, but that doesn’t mean I won’t go on with it, just like the speech. And that I won’t be good at it, but there are just some things I would prefer not to do!”


Q. Success doesn’t equal happiness, yet you seem so hopeful and modest?


A. “I am always hopeful as a person, I have been since I was little…I really want things to be good. As I mention in the book, I wake up everyday expecting it to be good, and if it is not, then I try to set about changing it before I go to sleep at night.”


Q. Would you describe yourself as religious or spiritual?


A. “Just spiritual, I am not religious. Although I grew up in a very religious family, but…I am no fanatic by any stretch of the word, and I am no angel, believe me. I wrote a song called ‘The Seeker’ many, many years ago, and it says ‘I am a seeker, just a poor sinful creature, there is no one weaker than I am.’


“People say, ‘What do you regret?’ I say, ‘I can’t say that I regret anything because at the time I was doing it, whatever it was, it seemed to be the thing to be doing at the time.’


“I have a good friend base, I have a good husband. So I have a lot of things and people who help me and guide me. I have never had to go to a psychiatrist, but I would if I thought that I needed to.


Q. But we are in New York, Dolly! No psychiatrist?


A. “Well yes (laughs), I guess not. But I do that in my songs, I write my feelings out and then I have such a strong faith and then I have such good friends. I am very close to several of my sisters, and we just talk about everything and anything….And my best friend Judy, there is nothing I can’t tell her, even if it is the awful-est thing in the world.”


Q. You recently had to deny gay rumors. Who is your greatest love?


“My husband is my greatest love, I have been with him 48 years…He is my best buddy.”


Q. Why do you think people always wonder about him?


A. “They don’t think he really exists! When I was doing my show, we were thinking about having a different guy knock on the door every night, as my husband, and then one night he would be a midget, and one night he would be a black man, and one night he would be like a boxer or a wrestler, all these different things that people imagine what my husband looks like.”


Q. You say that looking so artificial works for you, as it lets you prove how real you are. Why all the plastic surgery?


A. “Because I need it. Why does anybody get it?”


Q. Why do you think you need it?


A. “Because I am in show business. I am not a natural beauty. And I am on camera all the time. And I just always see, like if I need – Oh take one of my chins off, at least! – Or whatever. I mean, I don’t go to extremes with it. I just do little bits and pieces, just to try and keep things touched up, just tweaking.”

Jewel parent says sale talks proceeding

Supervalu, the Minneapolis-based parent of Jewel-Osco said sale talks are proceeding after stock closed down more than 18 percent Thursday, to $2.28.

The beleaguered grocery chain was likely moving to combat reports that sale talks with suitor Cerberus Capital Management had stalled over funding.

"The company continues to be in active discussion with several parties," according to the statement. "There can be no assurance that this process will result in any transaction or any change in the Company's overall structure or its business model."

Supervalu, the third-largest U.S. grocery chain, has acknowledged sale talks since the spring. The company has been closing stores and cutting jobs as it has underperformed competitors like Dominick's parent Safeway and Kroger.

If Supervalu does not sell to Cerberus, it may have to restructure on its own or sell off individual assets, which could have big tax consequences, Bloomberg said.

Reuters reported last month that buyout firm Cerberus was preparing a takeover bid for Supervalu, the third-largest U.S. supermarket chain.

Cerberus officials could not be reached immediately for comment.

Attorney accused of letting suspect use cellphone acquitted

Attorney Sladjana Vuckovic was acquitted tonight of charges she improperly gave her personal cell phone to a client who was being questioned in the murder of a Chicago police officer.

A Cook County jury deliberated a little less than three hours before acquitting Vuckovic of two counts of bringing contraband into a penal institution.






The jury began deliberating at about 3:55 p.m.

Sladjana Vuckovic, 44, was charged with a felony count of bringing contraband into a penal institution, faced up to 15 years in prison if convicted and would likely be disbarred from practicing law.

In closing arguments this afternoon in Judge Evelyn Clay’s packed courtroom, attorneys from both sides acknowledged the unusual nature of the case.

Assistant State’s Attorney Michael Golden told jurors that “anyone with common sense” should have known not  to let a suspect in custody for murder use a personal cell phone.

“You shouldn’t expect that attorneys across the country would be charged with such abysmal behavior,” Golden said.

Vuckovic’s attorney, Leonard Goodman, countered that common sense should tell jurors that Vuckovic wasn’t trying to obstruct the police investigation or “help some suspect cook up an alibi or destroy evidence.”

Goodman suggested to jurors that prosecutors were trying to insinuate there was an insidious motive for the calls “to trick you into convicting her based on something that this case is not about.”

The comment drew vehement objections from prosecutors.

“Counsel says she didn’t know it was wrong?” Golden said. “Well maybe somebody should tell her.”

Vuckovic was volunteering for a free legal service for indigent suspects when she twice went to the Calumet Area headquarters in November 2010 to meet with Timothy Herring after a relative of his had contacted the legal hotline about his arrest. Herring was undergoing questioning by detectives in the slayings of Officer Michael Flisk and another man.

Vuckovic testified in her own defense Wednesday she had made at least 100 client visits at police stations and had never been told that cellphones were prohibited. She said she was vaguely aware of a state law prohibiting bringing contraband into a penal institution but thought it barred "knives, guns, drugs." She also said that unlike a police lockup where suspects are behind bars, she didn't consider an interrogation room to be a penal institution.

Prosecutors alleged that 26 calls were made from or received by Vuckovic's cell phone during two meetings with Herring, including incoming calls from a number that was blocked.
